How can you place an order?

1) Registration:

The access to the www.terrerouge.fr website is for professional use only.
To enter the website, see the collection or order, the customer needs his email address and a password.
To define and confirm his password, the customer just has to click on “new customer” and fill a registration form.
The password will allow him to enter our website and place an order when he wants.

1) Orders:

To have access to our collection and order, the customer has to identify himself.
He has to fill at the top on the right of the screen the fields “e-mail” indicating his email address and “password” indicating the selected password, we confirmed him.

He can then enter in our shop on-line and start to select his items.

For each item there’s a minimum quantity, (see “minimum quantity”) to respect while placing your order.

The price indicated is the price for one single item independently of the minimum quantity.

The customer will receive within 48 hours an email confirming his order.

Terre Rouge reserves the possibility to confirm all or part of the order for any kind of reason: according to the stocks, previous disputes with the customers, items delivered in a close geographical area….

The orders are submitted to the agreement by the buyer of the above mentioned conditions, all the clauses and conditions contrary to them will be considerate invalid, null and void.

2) Prices:

The goods are supplied at the prices in effect at the time the order was placed.
The prices are in Euros.
The transport costs are not included. They will be communicated on the pro forma invoice and depend on the weight of the parcels and on the place of delivery.

3) Transport - delivery:

The deliveries are provided by our carriers or by the Post, except if the customer prefers to use his own carrier.
Terre Rouge applies itself to respect the delivery time but a delay can’t be a sufficient reason to cancel the order or to ask for compensation.
Terre Rouge is released from the obligation to deliver in case of fire, flood, strikes or circumstances beyond its control.
All the operations of transport and handling are made at customer’s own risks. The customer has to control the delivered goods and to take proceedings against the carriers, even in case of free transport costs, as part of the articles 105 and 106 of the commercial law. In case of a too damaged parcel, the customer has to reject it.
All customer complains regarding good defects, inexact quantities or wrong references compared to the original order, have to be put down in writing and transmitted to Terre Rouge within 48 hours after the receipt of the goods, otherwise the complain will be null and void.

4) Payment conditions – Payment terms:

The orders have to be paid to Terre Rouge before the delivery on the basis of the amount of the pro forma invoice and not on the basis of the internet order form.
All kind of exceptions and/or particular conditions to this rule must be agreed, put down in writing and signed by Terre Rouge. The orders have to be paid without any kind of discount except if expressly writing on the order form.

The amounts remaining to be paid after the payment date written on the Terre Rouge invoices and beyond the payment terms established on the conditions of sale, will cause the enforcement of:
- a 15% penalty of the outstanding amount.
- delay interests calculated on the basis of the amounts remaining to be paid and twice the legal monthly interests rate per month of delay – all period inferior to 30 days is considerate as a full month (Law N°92.1442 dated 1992/12/31)

5) Disputes - returns:

As an indication, Terre Rouge informs about the essential characteristics of the goods - composition, size, colour….
The photos illustrating the products are only for information. Terre Rouge is not responsible for eventual differences of shapes and sizes (as most of the items are hand-crafted products, changes of sizes, colour… may appear on the same reference from an item to another).

Any return of goods has to be agreed by Terre Rouge.
Items that wouldn’t correspond to the description on the website or that wouldn’t have a sufficient quality can be returned by post to be exchanged or refunded within seven days (postmark as proof) to the following address

6) Customer details:

Details of the customer are requested while processing the order. The customer certifies to be aware of this fact and can change at any moment his details in accordance to the law N°78-17 dated 1978/01/06.
The details given are hold by Terre Rouge and will never be transmitted to a third party (except to credit insurance companies*). They will be used for the order registration, customer account administration, requests of information, complains, fraud prevention, Terre Rouge marketing or commercial operations to inform about special offers.
* to reduce unpaid invoices and frauds.

7) Intellectual property:

The customer is not allowed (except if expressly authorized by Terre Rouge):
- To copy or download all or part of the contents of the website www.terrerouge.fr -Terre Rouge being the owner of all the intellectual property rights.
- To put a link to the Terre Rouge website on another website, as Terre Rouge is a registered trademark and can’t be used without authorization.
Terre Rouge deposits copyright to competent official organizations for most of the goods on the website.

8) Juridiction clause:

The customer expressly agrees that, in case of lawsuits and whatever the matter may be, only the Terre Rouge head office courts will be competent, even if clauses are written on the order form and/or confirmation, correspondences, customer invoices.
The creation and/or the acceptance of business bills won’t carry out derogation to this clause.

9) General terms and conditions of sell:

By these presents, the seller is defined by Terre Rouge on one hand, and the buyer by customer, on the other:

The customer certifies to be aware of the general terms and conditions of sell, as all the Terre Rouge sells are submitted to them, and accepts them for the business relations with Terre Rouge. Any derogation and / or particular condition must be agreed, put down in writing and signed by Terre Rouge.
